General Conditions of Sale
1. Definition of the parts
1.1 The website www.goestasy.com (hereinafter simply referred to as the "Site") is owned by VIDEO TRADE S.R.L Registered at the Chamber of Commerce of Naples, REA number 619676, VAT number and Tax Code 07451700632, Share Capital €10,900 fully paid up - Registered office in via Beniamino Guidetti, 102 – 80126 NAPLES (NA) PEC: videotradesrl@arubapec.it (hereinafter simply referred to as "VIDEO TRADE").
1.2 The sale of products through the Site constitutes a distance contract governed by Legislative Decree 6 September 2005, n.206 ("Consumer Code") and by Legislative Decree 9 April 2003, n. 70 containing the rules of electronic commerce.
1.3 This contract is stipulated between the Consumer Customer indicated in the order form (hereinafter simply referred to as the "Customer") and the company VIDEO TRADE S.R.L owner of the Site.
1.4 Pursuant to Article 3, paragraph 1, letter a) of the Consumer Code, we remind you that a Consumer is a natural person who acts for purposes outside of any entrepreneurial, commercial, craft, or professional activity he or she may carry out.
2. Conditions of sale
2.1 The applicable conditions of sale are those in force on the date of transmission of the purchase order.
2.2 By placing the order, the Customer acknowledges and declares that he has read all the information provided during the purchase procedure and that he fully accepts the general conditions of sale (this contract).
2.3 Only persons who have reached the age of 18 may validly purchase goods online on the Site.
2.4 By placing the order, the Customer declares that he or she is of legal age and is aware that the goods purchased are intended for an adult audience.
2.5 By submitting the order form, the customer undertakes to make payment in the manner described in Article 4 of this contract.
3. Purchase methods
3.1 The customer may only purchase products listed in the Site's catalog at the time of placing the order, as described in the relevant information sheets. For products listed in the Site's catalog with an available quantity of 0, the order may be placed, but it will be fulfilled as soon as the item becomes available again in the quantity desired by the customer. In any case, the products listed on the Site are offered while supplies last.
3.2 The image accompanying the product description may not be perfectly representative of its characteristics.
3.3 The Customer purchases the goods by electronically submitting the order form, which will constitute contractual acceptance; purchase orders for products sent to VIDEO TRADE must be completed in all mandatory fields, otherwise they will be deemed unacceptable.
3.4 The order form allows the user to clearly and unambiguously identify the prices for purchasing the products and the shipping and delivery costs applied by the courier; these amounts are the responsibility of the Customer.
3.5 VIDEO TRADE reserves the right to cancel or refuse orders from a Customer who has previously violated these General Conditions of Sale, or from a Customer who has provided false or incomplete identification data.
3.6 The order form will be sent electronically to VIDEO TRADE only upon confirmation of the order by the Customer.
4. Payment methods
4.1 Payment for products purchased through the Site can be made using the methods described in the following paragraphs.
4.2 Credit Card
4.2.1 In the case of purchases of products with payment by credit card, at the same time as the conclusion of the online transaction, the relevant issuing company will authorize the debit relating to the purchase made.
4.2.2 The transaction will be considered successfully concluded when the amount is charged to the Customer's Credit Card.
4.2.3 At no point during the purchase process will VIDEO TRADE be able to access the customer's credit card information, which is transmitted via a secure connection directly to the website of the card issuing company that manages the transaction. No computer archive of this information will be held by VIDEO TRADE. Under no circumstances will VIDEO TRADE be held responsible for any fraudulent or improper use of credit cards by third parties when paying for products purchased on the Site.
4.2.4 Accepted credit cards are visible on the payments page and are displayed again at checkout.
4.3 Bank Transfer
4.3.1 Payment for products purchased on the Site can be made via advance bank transfer. The bank details for making the transfer are indicated on the site's payment page and will be displayed again upon order confirmation.
4.3.2 Shipment of the products ordered by the Customer will be suspended until the amount due has been credited to VIDEO TRADE's bank account. Only then will VIDEO TRADE process the order and ship the products to the Customer.
4.3.3 The bank transfer must be made within 5 business days of placing the order with VIDEO TRADE. After this period, the contract will be automatically terminated and the order will be cancelled.
4.3.4 The Customer must provide proof of the bank transfer order by sending a copy to VIDEO TRADE via email to the address hello@goestasy.com
4.3.5 The transferred amount must be credited within 8 business days of placing the order with VIDEO TRADE. After this period, the contract will be automatically terminated and the order will be cancelled.
4.3.6 The reason for the bank transfer must include the order number displayed at the time of completing the order.
4.4 Payment with PayPal® electronic money
4.4.1 Payment for products purchased on the Site can be made using PayPal. If the Customer chooses PayPal as the payment method, they will be redirected to their site, where they will pay for the products according to the procedure established and regulated by PayPal and the terms and conditions agreed upon by the Customer with PayPal.
4.4.2 The data entered on the PayPal website will be processed directly by PayPal and will not be transmitted or shared with VIDEO TRADE.
4.4.3 VIDEO TRADE is NOT able to know and does not store in any way the data of the entered Credit Card or the Customer's PayPal account.
4.4.4 The transaction will be considered successfully concluded when the amount is credited to VIDEO TRADE's PayPal account.
4.5 Payment on delivery
4.5.1 Payment for products purchased on the Site can be made upon delivery by choosing the cash on delivery payment method.
4.5.2 If you choose cash on delivery, an additional delivery fee will be charged. The exact amount of this fee is specified on the shipping page and will be specified on the order form before sending it to VIDEO TRADE.
4.5.3 Payment for the fee can only be made in cash up to a maximum of €999.99.
4.5.4 Failure by the Customer to pay the cash on delivery fee will result in termination of the contract due to breach of contract by the Customer and violation of Article 2.5 of the Terms of Sale.
5. Prices
5.1 Product prices include VAT and are indicated in the product information sheets and on the order form in Euros.
5.2 VIDEO TRADE reserves the right to change the price of the product at any time, including multiple times during the same day. It is understood that the price of the product charged to the Customer will be the one indicated in the order summary, viewed by the Customer before placing the order, and that any changes subsequent to the order being submitted will not be taken into account.
5.3 In the case of a product offered on the Site at a discounted price, the full reference price on which the discount is calculated will be indicated on the Site.
6. Shipping and delivery
6.1 Products purchased by the Customer are delivered throughout Italy and to the countries indicated. The following locations are excluded: Campione d'Italia and Livigno.
6.2 Deliveries to remote locations or smaller islands may incur a surcharge, which will be highlighted when completing the order form.
6.3 Delivery is subject to payment, and unless otherwise specified, delivery costs are borne by the Customer.
6.4 The amount of the delivery costs owed by the Customer is indicated in Euros and inclusive of VAT, clearly specified during the purchase process, in the order summary and, in any case, before the customer proceeds to transmit the order to VIDEO TRADE.
6.5 The total order price will be indicated in the order summary, and therefore before the Customer sends the order to VIDEO TRADE, with separate indication of shipping and handling costs. This total will constitute the total amount owed by the Customer for the purchased products.
6.6 Shipping and delivery to the address indicated on the order form will be via express courier.
6.7 Delivery will take place only and exclusively to the person and address indicated when completing the order form.
6.8 Upon delivery of the goods by the courier, the Customer is required to check that the packaging is intact, undamaged, not wet, or otherwise altered, including the sealing materials. Any damage to the packaging and/or products must be immediately reported, by writing a specific "RESERVATION OF INSPECTION" on the courier's delivery receipt. Once the courier's document has been signed, the Customer will NOT be able to raise any disputes regarding the delivery.
6.9 As required by current legislation, the maximum deadline for reporting transport damage to VIDEO TRADE is 8 days from the moment of receiving the order.
6.10 The times established for the delivery of the goods must be considered indicative.
6.11 Unless the customer has chosen home delivery by appointment or at a specific time, delivery will be made from Monday to Friday between 9:00 and 18:00, excluding national holidays.
6.12 The Customer acknowledges that collection of the goods is their express obligation. If the delivery method chosen by the Customer does not include delivery at the agreed-upon time, in the event of a failed delivery due to the recipient's absence, the courier will leave a notice documenting the delivery attempt. The notice will also contain the contact information where the Customer can contact the courier to arrange for redelivery or how to collect the package.
6.13 In the event of a failed delivery attempt, the Customer is required to collect the package within 10 calendar days from the day after the delivery notice was left. If the Customer fails to collect the goods within this period, the purchase contract may be considered terminated, pursuant to and for the purposes of art. 1456 of the Italian Civil Code. VIDEO TRADE will then refund the total amount due, if already paid by the Customer, minus home delivery costs, storage costs, and the cost of returning the package to VIDEO TRADE, as well as any other costs incurred as a result of the failed delivery due to the recipient's absence.
6.14 The Customer is required to indicate any specific details regarding the delivery address and location when completing the order by inserting a note in the order in the appropriate space provided at the end of the purchase process and before submitting the order. Failure to provide such information or providing incorrect information will result in the Customer being responsible for any additional costs VIDEO TRADE incurs for the delivery of the product.
6.15 VIDEO TRADE undertakes to ship the goods within 24 hours of receiving payment for the order. In the event of an impediment, the customer will be notified, the order will be cancelled, and the full amount will be refunded.
6.16 Collection from a Depot
6.16.1 To use this method, the Customer must select the "Fermo Deposito" option during the purchase procedure and when completing the order form and choosing the branch to which he or she wishes the goods to be delivered.
6.16.2 If the customer has chosen to collect the goods from a courier branch, they will be notified by SMS when the goods are available for collection.
6.16.3 The Customer has 10 calendar days from the date of notification to collect the goods. If the Customer fails to collect the goods within this period, the purchase contract may be considered terminated, pursuant to and for the purposes of art. 1456 of the Italian Civil Code. VIDEO TRADE will then refund the total amount due, if already paid by the Customer, minus home delivery costs, storage costs, and the cost of returning the goods to VIDEO TRADE, as well as any other costs incurred as a result of the failure to collect the goods.
6.17 Collection at Poste Resister
6.17.1 To use this method, the Customer must select the "Restante Posta" option during the purchase procedure and when completing the order form and choosing the Poste Italiane post office where he or she wishes the goods to be delivered.
6.17.2 If the customer has chosen to collect the goods from a Poste Italiane post office, they will be notified by SMS when the goods are available for collection.
6.17.3 The Customer has 10 calendar days from the date of notification to collect the goods. If the Customer fails to collect the goods within this period, the purchase contract may be considered terminated, pursuant to and for the purposes of art. 1456 of the Italian Civil Code. VIDEO TRADE will then refund the total amount due, if already paid by the Customer, minus home delivery costs, storage costs, and the cost of returning the goods to VIDEO TRADE, as well as any other costs incurred as a result of the failure to collect the goods.
7. Personal data
8.1 Pursuant to Article 23 of Legislative Decree No. 196/2003, the Customer freely and expressly consents to the processing of his/her personal data, having read the Privacy Policy published pursuant to Article 13 of the aforementioned decree.
8. Advertising messages
9.1 The Data Controller will not send commercial information without the Customer's prior consent, as specified in the Privacy Policy published pursuant to art. 13 of Legislative Decree no. 196/2003.
9. Right of withdrawal
9.1 Pursuant to Articles 52 et seq. of the Consumer Code, the Customer who is a consumer has the right to withdraw from the purchase contract for the Goods, without having to provide any reason and without incurring costs other than those set forth in Article 10.7 below, within fourteen calendar days ("Withdrawal Period") from receipt of the Goods.
9.2 To exercise the right of withdrawal, under penalty of forfeiture, the customer can:
a) request a specific form from the customer service to be filled in and sent back by email to the address hello@goestasy.com
b) send a registered letter with return receipt to VIDEO TRADE S.R.L Via Beniamino Guidetti, 102 – 8016 NAPLES (NA)
c) fill in the appropriate form
9.3 The right of withdrawal can only be exercised with respect to the product purchased in its entirety.
9.4 The right of withdrawal CANNOT be exercised for audiovisual products.
9.5 Purchased products must be returned intact, in their original packaging, complete in all its parts (including manuals, accessories, documentation, etc.) and never used.
9.6 In the event of a return of all the products in the shipment, the gift must also be returned.
9.7 The Customer must return the products to VIDEO TRADE using a carrier of their choice and at their own expense, without undue delay and in any case within 14 calendar days from the date of notification of withdrawal. The goods must be sent to the following address: VIDEO TRADE S.R.L via B.Guidetti, 102 80126 Naples (NA).
9.8 VIDEO TRADE is not responsible for damage, theft or loss of products returned with shipments made by the Customer.
9.9 Products paid for by cash on delivery or freight collect will not be collected.
9.10 VIDEO TRADE will refund the sums paid as quickly as possible and in any case no later than 30 days after receiving the products and verifying their integrity.
9.11 Additional costs such as shipping costs, cash on delivery, appointment fees, and island surcharges will not be refunded.
10. Legal Guarantee of Conformity
10.1 All products sold on the Site are covered by the legal guarantee of conformity provided for by Articles 128-135 of the Consumer Code (Legal Guarantee).
10.2 The Legal Guarantee is reserved for Consumers. Therefore, it applies only to users who have made purchases on the Site for purposes other than any entrepreneurial, commercial, artisanal, or professional activity they may carry out.
10.3 VIDEO TRADE is liable to the consumer for any lack of conformity existing at the time of delivery of the product and which becomes apparent within two years of such delivery. The lack of conformity must be reported to the seller, under penalty of forfeiture of the warranty, within two months of the date on which it was discovered.
10.4 To benefit from the Legal Guarantee, the Customer must provide proof of the date of purchase and delivery of the goods. It is therefore advisable for the Customer, for the purposes of such proof, to retain the order confirmation or any other document that can certify the date of purchase and the date of delivery (for example, a credit card statement or bank statement).
10.5 There is a lack of conformity when the purchased product:
a) is not suitable for the use for which goods of the same type are normally used;
b) does not conform to the description given by the seller and does not possess the qualities of the good which the seller presented to the consumer as a sample or model;
c) does not have the qualities and performances which are normal in goods of the same type and which the consumer can reasonably expect, also taking into account the declarations made in advertising or on labelling;
d) is not suitable for the particular use intended by the consumer and which was brought to the attention of the seller by the consumer at the time of conclusion of the contract and which the seller accepted.
10.6 Any faults or malfunctions caused by accidental events or by the Customer's responsibility or by use of the product that is not compliant with its intended use and/or with what is provided for in the technical documentation attached to the product are excluded from the scope of the Legal Guarantee.
10.7 In the event of a lack of conformity duly reported within the terms, the customer has the right:
- primarily, to the free repair or replacement of the goods, at his choice, unless the requested remedy is objectively impossible or excessively onerous compared to the other;
- secondarily (i.e. in the event that the repair or replacement is impossible or excessively onerous or the repair or replacement has not been carried out within a reasonable timeframe or the repair or replacement previously carried out has caused significant inconvenience to the consumer) to a reduction in price or termination of the contract, at the consumer's discretion.
The remedy sought is excessively onerous if it imposes unreasonable costs on the seller in comparison with alternative remedies that can be pursued, taking into account (i) the value that the good would have if there were no lack of conformity; (ii) the extent of the lack of conformity; (iii) the possibility that the alternative remedy can be pursued without significant inconvenience for the consumer.
10.8 In the event that a Product, during the validity period of the Legal Guarantee, manifests what could be a lack of conformity, the Customer must contact Customer Service using the contact details in Article 13 below.
11. Resolution
11.1 In the event of non-fulfillment, even partial, of the obligations by the Customer, VIDEO TRADE reserves the right to terminate this contract pursuant to and for the purposes of art. 1456 of the Civil Code with simple written communication to be sent by registered letter with return receipt.
11.2 VIDEO TRADE also reserves the right to refuse any future purchases from the defaulting Customer, and also reserves the right to take legal action to protect its rights.
11.3 In any case, VIDEO TRADE's rights to receive fees for the services used, as well as the right to compensation for damages, remain unaffected.

13. Limitations of liability
13.1 VIDEO TRADE cannot be held responsible for any loss or damage suffered by the Customer or the recipient due to delays, slowdowns, or interruptions in the e-commerce service, if the delays, slowdowns, or interruptions do not depend on its own conduct or are caused by the malfunctioning of telecommunications services, including value-added services, energy supplier services, or Internet access services.
13.2 Furthermore, VIDEO TRADE cannot be held liable for any loss or damage suffered by the Customer due to delays, slowdowns, or interruptions in the e-commerce service, or due to delays in the execution of the purchase order or due to the failure to execute the same, if the delay, slowdown, interruption, or failure to fulfill the order is caused by an impediment beyond its control, which could not reasonably have been foreseen, and the consequences of which could not have been avoided or limited.
13.3 VIDEO TRADE cannot be held responsible for any loss or damage suffered by the Customer due to delays in delivery by the courier.
14. Jurisdiction and competent court
14.1 This contract and all legal relationships arising therefrom are governed exclusively by Italian law; any dispute relating thereto is subject to exclusive Italian jurisdiction.
14.2 Without prejudice to the application of mandatory provisions of law established for the protection of the consumer, any dispute in any way connected to these general conditions of contract is devolved to the exclusive jurisdiction of the Court of Naples.
